Attorney Marco Randazza has an interesting article on his blog concerning the Boston Red Sox's fight to prevent some guy from trademarking the phrase "Sex Rod" using the same font that the Red Sox use. I commented that if the only reason the application was turned down was that the applicant couldn't demonstrate that he (or she) intended to use the mark, that some adult company might want to give the trademarking a shot.
